1. Agreement
By accessing or using Kinetic AI at kineticai.us (the "Service"), operated by Kinetic AI, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. The Service
Kinetic AI provides a multi-tenant AI workspace including document ingestion, retrieval-grounded chat, background agent orchestration, and a Canvas output surface. Features and availability may change as we improve the product.
3. Accounts
- You must provide accurate registration information and keep credentials secure.
- You are responsible for all activity under your account and organization.
- One self-service signup provisions one organization workspace unless otherwise agreed in writing.
- You must be at least 18 years old and authorized to bind your organization.
4. Subscriptions & billing
Paid plans are billed monthly through Stripe at the rates displayed at checkout (Starter Team, Business Growth, or Enterprise as contracted). Subscriptions renew automatically until canceled. Workspace access requires an active subscription unless otherwise agreed.
Refunds are handled on a case-by-case basis. Contact Us for billing questions. Enterprise customers are governed by separate written agreements where applicable.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Attempt to access another organization's data or bypass tenant isolation
- Upload malware, illegal content, or material you lack rights to use
- Reverse engineer, scrape, or overload the Service without permission
- Resell or sublicense the Service except as explicitly permitted
6. Your content
You retain ownership of documents and data you upload. You grant us a limited license to process that content solely to provide the Service (including indexing, retrieval, and generating responses within your workspace). You represent that you have the rights necessary to upload your content.
7. AI outputs
AI-generated responses and Canvas outputs may be inaccurate or incomplete. You are responsible for reviewing outputs before relying on them for legal, medical, financial, or other high-stakes decisions. The Service is a productivity tool, not a substitute for professional judgment.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kinetic AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Termination
You may cancel your subscription at any time through Stripe or by contacting support. We may suspend or terminate access for violation of these Terms or non-payment. Upon termination, your right to use the Service ends; data handling is described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the United States and the state in which Kinetic AI is organized, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
12. Changes
We may modify these Terms by posting an updated version on kineticai.us. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance.
